Thirteen years later, firing Qassam rockets at a civilian population is still a war crime

For many years the State of Israel and its security forces have found themselves in a constant battle with the NGO B'Tselem, concerning the protecting of Israeli citizens from terrorism and terrorist entities. The widely held belief that B'Tselem's approach endangers the lives of both Israeli civilians as well its security personnel is held by many, so even in the best of cases B'Tselem's opinions are quite often rejected out of hand. However, this piece written in 2006, does clearly raise and address the rocket fire from Gaza, and label it for what it is. Interesting sidepoint that back in 2006 the Palestinian Authority was considered to be the entity to be held accountable. Today, this would include Hamas or any other terrorist entities that proudly proclaim responsibility for rocket launches.

From June 2004 to the end of March 2006, thirteen civilians, five of them minors, were killed by Qassam rockets that Palestinians fired into Israel and at Israeli settlements in the Gaza Strip. Eight of the victims were Israeli, four were Palestinian, and one a Chinese national. The rocket attacks also caused substantial property damage.

The Palestinian organizations responsible for the rocket-fire state openly that one of their aims is to kill Israeli civilians. Deliberate attacks on civilians are both immoral and illegal. The willful killing of civilians is classified as a grave breach in the Fourth Geneva Convention and as a war crime that is unjustifiable under any circumstances. Furthermore, Qassam rockets are themselves illegal, even when aimed at military objects, because the rockets are so imprecise, and thus endanger civilians situated in the area in which the rockets are fired or where they land. Therefore, the persons involved in firing the rockets violate the requirements of distinction and proportionality, which are fundamental principles of international humanitarian law.

To aggravate matters, many of the rockets are fired from, or near, areas in which civilians live. International humanitarian law prohibits attacks from inside or near the homes of civilians, and from using civilians as human shields. IHL's objective is to reduce to a minimum injury to civilians during an anticipated military response by the other side. The Palestinian organizations that carry out the attacks against Israel from within or near a populated area breach this rule; in doing so, the organizations show their indifference to the loss of Israeli and Palestinian lives.

Reflections on Deir Yassin, the Nakba, and War Crimes - by Dr. Arnon Groiss

...Anyone expressing an aversion to war crimes should be expected to do so with regard to all parties to a conflict. Accusations of war crimes directed at one side only, without the slightest sign of self-criticism regarding one’s own atrocities, indicate a fundamental lack of integrity. Moreover, alongside denunciation of past cases, one should emphatically act against incitement to future war crimes, such as those spelled out or implied in the new Palestinian schoolbooks. Anyone who fails to do so is actually encouraging war crimes.

Two important Hebrew-language books were published recently: Deir Yassin: The End of the Myth by Eliezer Tauber (Kinneret, Zmora-Bitan, Dvir 2017), and Nakba and Survival: The Story of the Palestinians Who Remained in Haifa and the Galilee, 1948-1956 by Adel Manna (Van Leer Institute Press, Hakibbutz Hameuhad Publishing House 2017). The value of these books emanates from their comprehensive presentation of data and facts hitherto not discussed.

Prof. Tauber, of Bar-Ilan University, gathered all the available testimonies related to the Deir Yassin battle from all involved parties, including both villagers and members of the attacking Etzel and Lehi underground groups. On the basis of these testimonies he provides a minute-by-minute analysis of the battle in the village’s various areas, indicating the death circumstances of each victim.

According to Tauber, Deir Yassin was the first case of house-to-house fighting in the 1948 war, as the defenders did not run away but fought from their houses until the end. The attackers broke into the houses by blowing up their doors, hurling hand grenades inside, and storming in while shooting. This resulted in many casualties, including non-combatants. Yet except for one case in which an attacker shot dead non-combatants who had surrendered and stepped out of their house, all the rest were killed during house-to-house fighting.

This conclusion is based on testimonies gathered from both surviving villagers and attackers.

Who would've thought? BBC 2’s ‘Newsnight’ squeezes Israel into Bosnia report - by Hadar Sela

...Of course some (and indeed many of the same) people would also like to see Britain in front of the International Criminal Court – particularly in relation to its military action in Iraq – but Mark Urban did not mention that.

Next week the UN’s International Criminal Tribunal for the Former Yugoslavia (ICTY) is due to deliver its verdict following the trial of the former Bosnian Serb military commander Ratko Mladić on charges of war crimes, crimes against humanity and genocide.

On November 16th BBC Two’s ‘Newsnight’ aired a report on that story (available in the UK here) by the programme’s diplomatic editor Mark Urban who previously covered the Bosnian war in the 1990s.

In addition to Urban’s filmed report viewers saw a discussion between programme presenter Emily Maitlis and Mark Urban, with the former introducing the item as follows:

Maitlis: “It’s time for the closing arguments in the most serious war crimes trial since Nuremberg at the end of World War Two.”

Shurat HaDin is going on the offense against those inciting to murder Jews. The extremist broadcasts on Palestinian Television have broken records in recent months. In the present wave of terror, many terrorists have been spurred into action after seeing provocative programs that call explicitly to kill Israelis.

When human rights advocacy appears indistinguishable from rationalizing the crimes of terrorists

...In the meantime, the family of Lt. Goldin still awaits the return of his body from Hamas that may be holding his remains in order to exact another gruesome exchange for live killers. If Amnesty wants to live up to its claim of advocacy for human rights, it might want to get involved in that issue. More to the point, the group and its financial backers need to understand that by conducting such attacks on Israel, it cannot pretend that is rationalizing the actions of one side in the conflict. In this case, their version of human rights advocacy appears to be indistinguishable from rationalizing the crimes of terrorists and seeking to hamstring the efforts of those seeking to stop them.

Yesterday, Amnesty International issued its latest broadside at the State of Israel. The group’s report, titled “Black Friday: Carnage in Rafah” dutifully reported at length by the New York Times, seeks to portray an incident from last summer’s war in Gaza as an example of particularly awful Israeli war crimes involving shelling of civilian areas and egregious loss of life. But, as with most such accusations, the closer you look at the charge the more it becomes clear that the point of the exercise isn’t merely a supposed quest for justice for dead Palestinians. While this must be seen in the context of a campaign to prepare war crimes charges against the Israel Defense Forces before the International Criminal Court that was recently joined by the Palestinian Authority, the effort has a broader purpose than merely beginning a human rights prosecution before that body. By expending a great deal of its limited resources on this one incident, Amnesty is seeking to make a much broader political point: delegitimizing Israeli self-defense under virtually any circumstances.

The incident that generated the reported took place on August 1, 2014. On that morning, a cease-fire between Israel and Hamas was put into effect that sought to end the war that had begun a month earlier. The conflict started when a Hamas terror cell kidnaped and murdered three Israeli teenagers and then escalated when the group began firing rockets at Israeli cities and towns. Several thousand of these missiles would be launched at Israel before the war ended. In addition to that, Hamas attempted to employ tunnels it had dug underneath the border with Israel to conduct more such kidnap/murder raids. Though the Israelis tried at first to halt the attacks with air power, when that didn’t work, ground forces were required to stop the terrorists. Though the August 1st cease-fire — like the one that later finally did end the shooting — left Hamas in place and in possession of its rocket arsenal, Israel agreed to it.

But only an hour after the fighting was supposed to stop, a Hamas terror squad ambushed a group of Israeli soldiers in the city of Rafah along the border with Israel. Two were killed and the body of one, Second Lieutenant Hadar Goldin, was dragged into the tunnel from which his attackers had emerged. That set off a desperate search and counter-attack aimed at recovering him and/or his body. That directive, known by the code name, “Hannibal” aims to use maximum force to prevent terrorists from escaping with a hostage. The order is always controversial because some interpret it as encouraging Israeli forces to even endanger the life of the captured soldier rather than standing down and subjecting both the individual and his country to a protracted hostage negotiation that inevitably involves the release of a disproportionate number of terrorist murderers.

In this case, Amnesty accuses Israel of using artillery fire in such a way as to conduct “disproportionate or otherwise indiscriminate attacks” on civilian areas with no regard for the lives of innocents who might be killed in the barrage. According to Amnesty and its Palestinian sources, the Israelis fired 1,000 shells and 40 bombs on the area where the Hamas assault took place resulting in 135 Palestinian deaths.

But while the loss of life during this battle was regrettable, the focus of the Amnesty report is remarkably skewed.

After all, the one war crime that we can be sure that took place was the attack on Goldin and his squad. It was a deliberate violation of a cease-fire that might have been a godsend for ordinary Palestinians, but which didn’t serve the purposes of Hamas. Having bled Gaza white for weeks, the leaders of the terrorist group were not yet satisfied with the toll of casualties among their own people. Hamas places its missile launchers and terror squads among civilians in order to deliberately expose them to Israeli fire. While there are plenty of fortified shelters in the strip for Hamas fighters and their massive arsenal, there are few for civilians. In Hamas-run Gaza, the shelters are for the bombs, not the people.

The ICC Gambit: Palestinians Should Also Be Wary of But ....

...False prosecutions brought against it in the ICC may well tie up Israel. But the same can just as easily be said about the Palestinians. Though they may have an international community that has proved tolerant of anti-Semitism on their side, the Palestinians need to understand that they are at least as vulnerable as the Israelis if not more so. The world’s hypocrisy when it comes to attacks on Jews has convinced them that they have nothing to lose. By putting their own actions under a legal microscope, there’s little chance that the PA will come out of this unscathed, let alone victorious.

In the wake of their failed attempt to get the United Nations Security Council to vote to recognize their independence without first making peace with Israel, the Palestinian Authority has begun the process of joining the International Criminal Court, where they will, according to UN Secretary General Ban Ki-moon, become full members on April 1. Their goal is to use this platform to harass Israel and to launch war-crimes trials against the Jewish state. This is widely seen as a credible threat against the Israelis who have been unfairly assailed for their conduct when fighting Hamas terrorists in Gaza. But the PA shouldn’t be so eager to head to court. The efforts of Shurat HaDin—Israel Law Center to charge Palestinian leaders with war crimes could turn the tables on them in a way that may cause them to regret their decision.

Though the U.S. has rightly argued that as a non-state, the PA cannot actually be part of the ICC, the UN has gone along with this farce. This will allow the Palestinians to begin making mischief for the Israelis by filing suits that will publicize a raft of specious charges all aimed at branding it as an “apartheid state” run by war criminals. This gambit not only helps the Palestinians avoid peace talks where they might be forced to either make peace with Israel or admit that they will never do so. It also aids their ongoing efforts to delegitimize Israeli self-defense against terrorist attacks like Hamas’s use of tunnels for cross-border kidnapping/murder raids and the launching of thousands of rockets at Israeli cities.

But the PA has opened up a Pandora’s box that they may not be able to close before it damages their own cause.

Justice Be Damned - Human Rights Activists vs. the International Court

Under other circumstances, I might enjoy watching “human rights” activists decry the very international justice system they lobbied so hard to establish. But not when reactions like this one, by David Harland of the Center for Humanitarian Dialogue, show just how much resistance there will be to the important norms established last month by the appellate court of an international war crimes tribunal in the Hague. In a verdict ironically issued just as the world was obsessing over Palestinian civilians killed in the latest Hamas-Israel war, the court essentially upheld, in a Balkan context, all the arguments Israel routinely makes about the legitimacy of its own military operations. Consequently, the judges acquitted and freed two Croatian generals whom a trial court had convicted of war crimes and sentenced to 18 and 24 years, respectively.

The appellate court’s first important move was acknowledging the obvious fact that in wartime even the most careful army makes mistakes. The trial court had convicted the Croats of illegally shelling four towns they were trying to capture. The appeals court said the lower court’s criterion–“that any shell that landed more than 200 meters away from a military target must have been fired indiscriminately–was arbitrary and ‘devoid of any specific reasoning’,” to quote The Guardian’s apt summary. In short, it accepted the fact that soldiers are human beings who make mistakes, and errant shells don’t necessarily mean the soldiers fired indiscriminately.

Second, it acknowledged the obvious fact that even the most careful army can’t prevent civilian casualties. Some 150 civilians died in the generals’ four-day bombing campaign. But the appeals court said these deaths didn’t constitute war crimes, because the troops had aimed at legitimate military targets. In other words, it ruled that civilian casualties aren’t ipso facto illegal; they may be unavoidable consequences of legitimate military activity–especially when military targets are located in crowded urban areas.

Surprise! Ha'aretz Allegation of War Crime Unfounded

In a recent Op-Ed, Israeli writer Yitzhak Laor, whose columns appear regularly in Ha'aretz, further fueled the industry of lies about Israel with a tried and true method: twisting or exaggerating a real incident so that the reader has no idea s/he read a lie, at worst, or an unsubstantiated claim, at best.

In his column about the first Lebanon war, Laor wrote (“Lebanon war was no deception,” June 5);

The Beaufort was conquered, the dead of Tyre and Sidon lay in the streets, our newspapers sang paeans of praise to the cherries, the Israel Defense Forces blew up the mosque in Ain al-Hilweh with hundreds of people barricaded inside, including children.

Thus, Laor casually charges Israel with a war crime. But did IDF forces blow up a mosque “with hundreds of people barricaded inside, including children”?

Rocket attacks against Israel are ignored by the hypocritical NGOs which turn a blind eye.

In the past month, Palestinians in Gaza have committed dozens of war crimes. They have launched deadly rockets and mortars at Israeli civilian targets in cities and towns across a very wide area. The terror teams who launch the rockets are murderers and those who give them direct support, protect them and provide them weapons are accomplices to their heinous crimes.

But those who target Israeli civilians from Gaza, in blatant violation of international law and basic morality, are enabled by a much larger group of people. These enablers include officials of numerous organizations that claim to promote human rights, and have remained largely silent for the many years in which these war crimes have been committed. Since August 2005, when the last Israeli civilians and military forces left Gaza, tens of thousands of rockets have been used to terrorize Israelis, but the failed network of human rights organizations has erased every one of these war crimes and violations.

The UN Human Rights Council has not held a single emergency session or other discussion on the crimes committed against Israelis. In contrast, on every occasion, UN High Commissioner for Human Rights Navi Pillay and her cohort of “special rapporteurs” have condemned Israeli efforts to end the terror, and invented war crimes allegations to advance these double standards.

In parallel, global human rights superpowers like Amnesty International and Human Rights Watch manipulate international law to condemn and disproportionately focus on Israeli actions.

This deadly, immoral combination of distorted human rights mechanisms in the UN and its NGO allies has produced a series of headline-grabbing reports with invented allegations against Israel, but not a single report on the real war criminals.

Afghan war logs, war crimes and proportionality

The British media’s handling of the release of over 90,000 classified military records from the war in Afghanistan is an important test for consistency in the reporting of ‘war crimes’ and ‘proportionality’ in the theatre of war.

These concepts are regularly invoked by journalists in the discussion of Israel's military actions, most recently following the Gaza flotilla raid in May 2010, and most commonly in relation to the Gaza war of 2008/9. Israel is routinely accused of 'war crimes' and use of excessive - or 'disproportionate' - force against the Palestinians and their supporters.

However, despite the fact that the leaked Afghan reports contain details of previously unreported Nato killings of hundreds of Afghan civilians, this research shows that virtually none of the reporting of this story in the UK has raised the spectre of ‘war crimes’ and the ‘disproportionate use of force’.


KEY FINDINGS:

• Of 52 articles published on the websites of BBC News, The Guardian, The Independent, The Times, The Daily Telegraph and Financial Times on 25/26 July, not one cited the international legal concept of ‘proportionality’

Prosecution of IDF officers cynically twists truth

Human rights lawyers and pro-Palestinian activists in a number of European countries hold lists with names of Israel Defense Forces soldiers allegedly linked to war crimes committed during Operation Cast Lead in the Gaza Strip. Existing legislation enables arrest warrants to be issued against these officers if they enter those countries.


Lawyers in Britain and other European countries have been collecting testimonies of Palestinians and other data from Gaza since January, which they maintain proves that war crimes were committed by the IDF during the offensive. The evidence is linked to IDF officers holding ranks of battalion commander and higher, who were in command during various stages of Cast Lead.


The other nations who have lawyers collecting information on the matter include the Netherlands, Spain, Belgium and Norway, whose laws, as well as Britain’s, allow the issuance of arrest warrants against foreign citizens suspected of war crimes.


All very official, not unlike ‘official’ Nazi legal procedures for confiscating Jewish property, etc. Naturally only the highest standards of ‘evidence’ will be used:


[British attorney Daniel] Makover said that the Goldstone report on the fighting in the Gaza Strip will bolster the efforts of the activists, and said that some of the instances mentioned in the report were already known to the attorneys. Makover is part of an unofficial network of attorneys operating in various countries in Europe, exchanging and sharing information so that suspected officers may be arrested in those countries.


Imagine my relief to know that the same careful forensic methods and the same standards of fairness that characterize the Goldstone reportand NGO ‘investigations’ will now drive an international manhunt to capture the criminals who have violated Rule No. 1:


Other public-spirited individuals will help assure that the ‘perpetrators’ do not escape ‘justice’:


The information is often received from pro-Palestinian activists who follow Jewish or pro-Israel groups that invite IDF officers to deliver lectures. In some instances, this information is relayed to border controls…


A number of human rights groups are busy working to create an international organization that would enable closer surveillance of those they suspect of war crimes and torture, as well as seek warrants for their arrest.


It also renews my faith in my fellow man to know that they are not depending on the authorities to bring these miscreants to justice. No, a network of ‘pro-Palestinian activists’ and ‘human rights groups’ will make sure the none of them slip away!


It would be unbelievable, if it were not true, that language, organizations and laws that originally came into being as a result of the horrific persecutions of Jews by the Nazis are being used today to aid the Palestinian Arabs — who were allied with the Nazis during the war — as they take part in the 100-year old war against Jews living ineretz yisrael.


The cynical twisting of truth that facilitates this is really a triumph of modern media manipulation in the supposedly ‘advanced’ countries of Europe. Göbbels himself would have to admire it.


There are other ironies. In the Warsaw Ghetto 66 years ago, Jews who tried to defend themselves were hunted down. Then, as now, the ‘authorities’ had the enthusiastic help of ‘activists’, Ukrainians, Latvians and some Poles (although in fairness, the Polish underground aided the Jews).


Imagine the empowerment of today’s ‘activists’, who in addition to demanding boycotts of Israeli products and professors can now actually help lock up a real live IDF officer!


Sometimes human behavior is so perverse, so ignorant, stupid and evil that the usual rhetorical tools, like irony, can’t begin to describe it. For years after, historians, novelists and poets struggle to explain the apparent pandemic insanity of a time or collection of events, like the Crusades or the Nazi era.


Today, when half the world is obsessed with the desire to stamp out a tiny nation with a tiny population, a nation with no significant natural resources except Jewish brains, is truly one of those times.

"We are with Sudan," said Abbas when asked about the Palestinian position about the international warrant for arrest issued against al-Bashir for war crimes in Darfur. Abbas added, "We are with the president. We support Sudanese unity and entirely agree with Sudan's position."
Why should Israel be expected to treat the International Criminal Court with any more respect than the Palestinians?
