Monday June 10 we met again at Opher Military Court to yet another of the endless heartrending trial hearings of the terror gang that murdered Asher and Yonatan Palmer HY"D on September 23, 2011, and of the terrorist who entered the car directly after the murders, and felt around and thus desecrated Asher's body in order to steal the gun and clip of bullets that Asher carried.
Sitting in the courtroom next to Michael Palmer, father and grandfather of the innocent man and infant who were murdered, is always heart breaking. We, who come to be with him, each time can only extend our love, sympathy and empathy for him and his family. We pray that our presence makes it a little less impossible to get through this on-going nightmare. I fully understand that for them nothing will ever be the same again after their unbearable loss.
The thief has of course an attorney who is trying to minimize the sentence of the accused and with a smirk on his face directed his unbelievable remarks to the military judge and prosecution.
During the previous court session, the defense lawyer attempted to gain the sympathy of the court by claiming that not only was the accused the sole support of his family, but that he had worked inside of Israel and never been involved in any crime.
The lawyer then began to describe the difficulties that Shchada, the accused, faced with the various illnesses in his family, and the financial stress that he had because of this. This time the defense even went further with his attempt to extort a light sentence from the court for his client. He explained again that Shchada was not a criminal, and with all of the sympathy that he and the defendant felt for the family's grief, this case is not connected to the deaths of Asher and Yonatan z"l.
The defense lawyer, I must note with a smirky smile on his face, continued to extol the accused and explain how difficult it is for him to support his family with the various physical handicaps and expenses. He then went on to reiterate that his client sympathizes with the family of the victims and wished to convey his condolences. The lawyer said that Shchada just happened upon this scene and when he violated Asher's dead body "it was because an evil spirit- a devil took him over." It was just about then, as I continued translating the explanations of the defense lawyer to Michael, that we looked at one another in the eyes and shaking our heads did not know what to say or even what to think.
How callously this lawyer dismissed the facts that his client saw the car spin down the cliff and crash. How he parked his car, walked down the ravine, entered the smashed car with the battered bodies of the victims, and with no compassion or feeling whatsoever committed this horrendous crime.
And the court is supposed to ignore all of this inhuman behavior because this cold-blooded criminal has family who are ill? What about the Palmer family who lost two innocent souls in this murderous attack? How could anyone ignore this tragic scene and after committing the crime, hide the gun inside his shirt, walk back to his car and tell his comrades to quickly leave the scene.
The defense boasted that the gun had not been used in any terrorist or criminal act. The defense reiterated the sympathy that he claims the defendant has for the sorrow of the Palmer family.
The lawyer asked the court to understand the circumstances of the actions of his client and how again he explained that this had nothing to do with the deaths of the victims.
I agree to the quest for the sympathy of the court, but not for the Arab terrorist who stole Asher's gun and clip. I request the sympathy and understanding of the court for the innocent victims, Asher and Yonatan Palmer z"l and their families, and hope that the court hands out the maximum sentence to punish this criminal and to deter any other in the future from acting as Shchada did.
